Terms of Service

1. Acceptance

By creating an account or using ForeverNear (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

2. What ForeverNear Provides

• AI-powered lifelike avatars generated from a reference photo.
• Synthesized voice based on a voice recording you supply.
• Real-time conversation with the avatar, grounded in biographical notes you provide.
• Plans: Remember ($29/mo), Cherish ($59/mo), and Partner (custom for funeral homes).

ForeverNear is a remembrance tool. It is not a substitute for the deceased, and it is not therapy or counseling.

3. Rights to Upload Likeness

You warrant that, for every photo and voice recording you upload:

• You are a member of the immediate family, the legal executor of the estate, or have written consent from the person depicted (or their legal representative).
• You have the legal right to create a likeness and voice model from that material.
• You agree to remove the avatar promptly if another next-of-kin objects in writing.

We reserve the right to suspend any avatar where ownership of the likeness is disputed.

4. Accounts

• You must be 16 or older to create an account.
• You are responsible for keeping your login credentials confidential.
• You must provide accurate information and keep it up to date.
• One account per person — multi-user access belongs on Partner plans.

5. Acceptable Use

You agree not to:

• Create an avatar of any living public figure or celebrity without consent.
• Use the Service to produce deepfakes, impersonations, or misleading content.
• Generate defamatory, harassing, obscene, or illegal output using the Service.
• Attempt to extract, export, or resell voice models or avatar weights.
• Use the Service to make statements attributed to the deceased that could cause harm to their reputation or to third parties.

6. Subscriptions & Billing

• Paid plans renew monthly until cancelled.
• Cancel anytime from your account settings; access continues through the paid period.
• First-time subscribers may request a refund within 14 days if they have not yet generated an avatar; refunds are reviewed case-by-case. Once an avatar has been generated, the subscription is considered in use.
• Billing is handled by Stripe; chargeback disputes should be raised with us first.

7. Intellectual Property

You retain ownership of the photos, recordings, and notes you upload. You grant STAIM CORP. a limited license to process that content solely to operate the Service for you.

The ForeverNear platform, avatar rendering pipeline, and software are the property of STAIM CORP.

8. Disclaimers

The Service is provided “as is.” AI-generated responses may occasionally be inaccurate, out of character, or emotionally difficult. We make no guarantee that the avatar will behave exactly like the person depicted.

If you are experiencing grief or mental health difficulties, please consider speaking with a qualified professional. ForeverNear is not a therapeutic service.

9. Limitation of Liability

To the maximum extent permitted by law, STAIM CORP. is not liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability is capped at the amount you paid us in the twelve months prior to the claim.

10. Termination

• You may close your account at any time.
• We may suspend accounts that violate these terms or upload disputed likeness material.
• On termination, your personal content is deleted within 30 days.

11. Changes

We may update these terms. Material changes will be communicated by email or in-app notice at least 14 days before taking effect.

12. Governing Law & Contact

These terms are governed by the laws of Ontario, Canada. Disputes will be resolved in the courts of Toronto, Ontario, unless local consumer protection law provides otherwise.
