1. Introduction
ForeverNear is a digital memorial service operated by STAIM CORP. (“we,” “us,” “our”). We help families keep the voices, faces, and stories of loved ones close by turning a photo and a voice recording into a lifelike talking avatar.
Because the data you entrust to us is uniquely personal — it represents someone you love — we take extra care with how it is collected, stored, and used. This policy explains exactly what we do.
2. Information We Collect
2.1 Information You Provide
Account Information
Name, email, login credentials, and optional billing information for paid plans (Remember, Cherish, Partner).
Photos of the Deceased
Reference photographs you upload to generate the avatar likeness. Used only for avatar generation; never used to train third-party models.
Voice Recordings
Audio clips you upload for voice cloning. Processed by ElevenLabs under a strict data-processing agreement. You can delete the source recording at any time.
Memory Notes & Biographical Details
Stories, personality notes, and background you provide so the avatar can respond in character. These are stored only on your account.
Conversations
Messages you exchange with the avatar. Conversations are private to your account and never shared, sold, or used to train public models.
2.2 Automatically Collected
- Device and browser information (for compatibility).
- General region from IP address (not precise GPS).
- Session logs, crash reports, and feature usage (opt-in).
3. How We Use Your Information
- Generate and render your avatar and synthesized voice.
- Deliver live conversation between you and the avatar.
- Process subscription billing and provide customer support.
- Improve the product through aggregated, anonymized analytics.
- Protect the service against abuse, fraud, and unauthorized access.
We never sell your data. We do not use your memorial content for advertising. Your loved one's voice and likeness are not used to train any third-party AI model.
4. Third-Party Services
We rely on a small set of vetted providers to operate. Each operates under data-processing agreements compliant with GDPR and CCPA:
- ElevenLabs — voice synthesis. Receives voice samples; does not retain for training.
- Anthropic (Claude) / OpenAI — conversation generation. Receives conversation text; zero retention configured.
- NVIDIA Audio2Face-3D — avatar lip sync. Processes audio streams locally during a session.
- Stripe — subscription billing. We never store card details.
- Encrypted storage — your avatars, voice models, and recordings are stored encrypted at rest. During the private beta, storage is hosted on our own infrastructure; production rollouts will move to AWS or an equivalent cloud provider with equivalent data-processing agreements.
5. Data Retention
- Avatars, photos, voice models: retained until you delete them or close your account.
- Conversations: stored on your account; you can clear history at any time.
- Account deletion: all personal content permanently erased within 30 days.
- Billing records: retained 7 years for tax and legal compliance.
6. Your Rights
Under GDPR, CCPA/CPRA, and PIPEDA you may:
- Request a copy of your personal data.
- Correct inaccurate information.
- Delete your account and all associated memorial content.
- Export your data in a portable format.
- Withdraw consent for optional processing at any time.
- File a complaint with your local data protection authority.

7. Consent & Ownership of Likeness
Because ForeverNear creates avatars of real people, you warrant that you have the legal right to upload each photo and voice recording — typically as a family member, executor, or with written permission from the person depicted.
We remove avatars immediately upon verified request from a next-of-kin or legal representative.

- TLS encryption for all data in transit.
- Encryption at rest for photos, recordings, and avatars.
- Access controls limiting who can view your memorial data.
- Voice-model access restricted to your authenticated sessions.
No system is perfectly secure. We work hard to protect your data and will notify you of any material breach.
9. Children's Privacy
ForeverNear is intended for adults. We do not knowingly collect data from children under 16. Accounts created for minors by a legal guardian are permitted with explicit written consent.
10. Changes to This Policy
We may revise this policy as the service evolves. Material changes will be announced via email or in-app banner before taking effect.
