Welcome to What Was Lost. Please read these Terms of Service (“Terms”) carefully before downloading, installing, or playing the Game. By accessing the Game, you agree to be bound by these Terms.
1. Acceptance of Terms
By downloading, installing, or playing What Was Lost (“the Game”), you accept and agree to be bound by these Terms. If you do not agree, you must not download or play the Game. These Terms apply in addition to the Steam Subscriber Agreement with Valve Corporation, which governs your use of Steam itself.
2. Description of the Game
What Was Lost is a 2-player cooperative atmospheric adventure game distributed on Steam. The Game includes:
- Online and local co-op multiplayer for two players
- Asymmetric perspective gameplay (Physical and Ethereal layers)
- Narrative-driven exploration and puzzle solving
- Cloud save support via Steam Cloud
- Periodic content updates, patches, and bug fixes
3. License Grant
Subject to these Terms and your continued compliance with the Steam Subscriber Agreement, STAIM CORP. grants you a limited, non-exclusive, non-transferable, revocable license to:
- Install the Game on devices you own or control via your Steam account
- Play the Game for personal, non-commercial entertainment purposes
- Stream gameplay or upload non-commercial Let's Play / review content (see Section 9)
All rights not expressly granted are reserved. This license does not grant you the right to modify, distribute, sell, sublicense, rent, or create derivative works of the Game.
4. Account & Eligibility
- You must have a valid Steam account in good standing to play the Game.
- You must be at least 13 years of age, or the minimum age required by your local jurisdiction.
- You are responsible for any activity occurring on your Steam account in connection with the Game.
- Account-level matters (suspension, refund eligibility, payment) are handled by Valve under the Steam Subscriber Agreement.
5. Online Co-op & User Conduct
When playing online co-op, you may interact with another player. You agree not to:
- Harass, threaten, or behave abusively toward other players
- Use cheats, exploits, mods, trainers, or third-party software to gain an unfair advantage
- Modify, reverse engineer, decompile, or disassemble any part of the Game
- Tamper with save files, network traffic, or anti-cheat systems
- Disrupt or interfere with the Game's servers or other players' sessions
- Use the Game for any illegal, fraudulent, or commercial purpose
- Impersonate STAIM CORP., its staff, or other players
We may suspend or revoke access for users who violate these rules. Disputes about a specific Steam account itself are handled by Valve.
6. Purchases & Refunds
All purchases of What Was Lost are processed by Valve Corporation through Steam. STAIM CORP. does not directly receive or store payment information.
- Pricing is displayed by Steam in your local currency before purchase.
- Refund requests must be made through Steam Support in accordance with Valve's refund policy.
- STAIM CORP. cannot directly issue, deny, or process refunds for Steam purchases.
If the Game is later sold on additional storefronts (e.g., Epic Games Store, GOG, console marketplaces), the refund and purchase policy of that storefront will apply.
7. Updates & Availability
We may release updates, patches, hotfixes, balance changes, or additional content for the Game. By continuing to play after an update, you accept those changes. We reserve the right to:
- Modify, suspend, or discontinue any feature of the Game with reasonable notice
- Take online services offline for maintenance or after end-of-life
- Adjust gameplay balance for fairness, performance, or stability
If online co-op services are permanently shut down, the Game's offline / local co-op functionality will remain playable to the extent technically possible.
8. Intellectual Property
All content in the Game is owned by STAIM CORP. or its licensors, including but not limited to:
- Visual art, environments, character designs, and animations
- Music, sound design, and voice work
- Story, dialogue, lore, and written text
- Game mechanics, systems, and software code
- Trademarks, logos, and the “What Was Lost” name and branding
All rights are protected by copyright, trademark, and other intellectual property laws.
9. Streaming, Video & Fan Content
We love seeing players share the experience. You may freely create, stream, or upload non-commercial gameplay videos, screenshots, Let's Plays, reviews, and fan art, including content monetized through standard platform programs (YouTube Partner Program, Twitch subscriptions, etc.) provided that:
- You do not present your content as official or endorsed by STAIM CORP.
- You do not redistribute the Game itself, its assets, or its source files
- You do not use the Game to promote hateful, illegal, or abusive content
For commercial licensing (e.g., paid sponsorships featuring the Game as the central product, esports broadcasts, or use of game assets in commercial projects), please contact [email protected].
10. User-Generated Content
If you submit feedback, bug reports, ideas, or other content to us, you grant STAIM CORP. a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, and incorporate such submissions into the Game or related materials, without compensation. Do not submit anything you are not authorized to share.
11. Disclaimers
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the Game will be uninterrupted, error-free, or secure
- Warranties regarding compatibility with all hardware, drivers, or operating systems
Online features depend on third-party infrastructure and your own internet connection; we cannot guarantee continuous availability.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAIM CORP. SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of save data, progress, or in-game items
- Loss of profits, revenue, or anticipated savings
- Damages resulting from third-party services, internet outages, or hardware failures
Our total aggregate liability for any claim arising from your use of the Game shall not exceed the amount you paid for the Game in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless STAIM CORP., its officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, or expenses (including reasonable attorney's fees) arising from your use of the Game, your User-Generated Content, or your violation of these Terms.
14. Termination
We may suspend or terminate your access to online features of the Game at any time if you violate these Terms or engage in conduct that harms other players. Upon termination:
- Your license to use online services is revoked
- Sections regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination
- Termination of online access does not by itself affect your underlying Steam purchase, which is governed by Valve
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the Game's Steam page, in-game notice, or this website. Continued use of the Game after changes constitutes acceptance of the updated Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
17. Dispute Resolution
Any dispute arising from these Terms or your use of the Game shall be resolved through:
- Good faith negotiation between the parties
- If unresolved within 30 days, binding individual arbitration under the rules of the American Arbitration Association
You agree to waive any right to a jury trial or to participate in a class action lawsuit, except where prohibited by your local law.
