Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Every Choice Matters (“the App”), you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

2. Description of Service

Every Choice Matters is an idle clicker game that includes:

• Progressive gameplay through multiple eras and zones
• Character upgrades and evolution mechanics
• Combat systems with bosses and enemies
• Offline progression and idle earnings
• Optional premium features via in-app purchase
• Optional advertisements (free version)

3. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, non-commercial entertainment purposes

This license does not include the right to modify, distribute, sell, or create derivative works based on the App.

4. User Conduct

You agree not to:

• Modify, reverse engineer, decompile, or disassemble the App
• Use cheats, exploits, automation software, or hacks
• Manipulate game data, save files, or system time to gain unfair advantages
• Circumvent or disable any security or integrity features
• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with other users' enjoyment of the App

5. In-App Purchases

a. Premium Features

The App offers optional premium features available for purchase. Premium purchases are:

• One-time, non-consumable purchases (you buy once, keep forever)
• Linked to your Apple ID or Google Play account
• Restorable on devices using the same store account

b. Pricing and Payment

• Prices are displayed in your local currency before purchase
• Payments are processed by Apple App Store or Google Play Store
• We do not have access to your payment information

c. Refunds

Refund requests must be directed to Apple or Google per their refund policies. We cannot process refunds directly.

6. Virtual Items and Currency

• Virtual items, currency, and progress in the App have no real-world monetary value.
• Virtual items cannot be sold, transferred, or exchanged outside the App.
• We reserve the right to modify virtual item values for game balance purposes.
• Loss of virtual items due to device issues, account problems, or service changes is not refundable.

7. Advertisements

The free version of the App displays advertisements provided by third-party ad networks. By using the free version, you acknowledge that:

• Ads may appear during gameplay at designated points
• Ad content is controlled by ad networks, not by us
• You may watch optional rewarded ads for in-game bonuses
• Premium users do not see advertisements

8. Intellectual Property

All content in the App, including but not limited to:

• Graphics, artwork, and visual designs
• Music, sound effects, and audio
• Game mechanics and systems
• Text, logos, and branding
• Software code and algorithms

9. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy of game content or information

We do not guarantee that the App will be compatible with all devices or operating systems.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAIM CORP. SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, progress, or virtual items
• Loss of profits or anticipated benefits
• Damages resulting from unauthorized access to your device or data

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for in-app purchases in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless STAIM CORP., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. Upon termination:

• Your license to use the App is revoked
• You must delete all copies of the App
• You forfeit any virtual items or progress
• Sections regarding intellectual property, disclaimers, and limitations of liability survive termination

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or by posting the updated Terms in the App. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Good faith negotiation between the parties
2. If unresolved within 30 days, binding arbitration under the rules of the American Arbitration Association

You agree to waive any right to a jury trial or to participate in a class action lawsuit.
